As most people in Minnesota with children will likely agree, being a parent is difficult, especially when small children are involved. In fact, driving with young children can be especially distracting. The 37-year-old woman was arrested one night in early August. According to reports, police received complaints about a driver who was possibly impaired. Police say they located the vehicle that was apparently the subject of the report at a gas station; the vehicle was still warm, according to police.
Officials says that the driver stumbled and swayed as she exited the gas station. She told police that she had not consumed alcohol and stated that she was a diabetic. However, police say that her blood alcohol content was over the legal limit according to a portable blood test. She also allegedly failed a field sobriety test.
As much faith as law enforcement officers in Minnesota place in devices used to determine blood alcohol content, the devices are not infallible. In fact, many are subject to human error; even when they may indicate that a person is over the legal limit, they could be incorrect.
