Two Minnesota men have been arrested in separate drinking and driving incidents within hours of each other. Both men were given field sobriety tests and one a breath test before receiving DWI charges. They are now likely working with attorneys to dispute these charges.
According to police, the first man was arrested shortly after 1 a.m after being stopped for a traffic violation. The officer claims that the man had a young child who was not properly restrained in the vehicle with him and had the smell of alcohol on his breath. The man allegedly refused a preliminary breath test, but agreed to a field sobriety test which he reportedly failed. He was arrested and took a breath test at the police station which registered .12 blood/alcohol content. The man was booked on suspicion of first-degree DWI.
Authorities report that the second man was arrested shortly after 5 a.m. after an officer stopped him for making an illegal turn. Similarly to the first incident, the officer alleged that he could smell alcohol on the man’s breath. Police report that the man failed a field sobriety test and registered .13 BAC at the police station. He is now facing a first-degree DWI charge.
In addition to disputing the charges these men are facing, they also have rights that must be protected.
